1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the TestOn AI platform, including all features, applications, content, and services made available at www.testonai.online and www.testonai.com (collectively, the "Service"), operated by [COMPANY LEGAL NAME] ("TestOn AI", "we", "us", or "our").

By creating an account, accessing, or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree, you must not use the Service.

The Service is intended for users who are at least 13 years of age. By using the Service, you represent and warrant that:

• You are at least 13 years old;
• If you are between 13 and 18 years old, you have obtained verifiable parental or guardian consent to use the Service;
• You have the legal capacity to enter into a binding contract in your jurisdiction;
• Your use of the Service does not violate any applicable law or regulation.

We do not knowingly collect personal data from children under 13. If we learn that we have collected data from a child under 13 without parental consent, we will promptly delete that data.

4. Account Registration & Security

4.1 Registration

To access most features, you must create an account using a valid email address and password, or via Google OAuth. You agree to provide accurate, current, and complete information during registration.

4.2 One Account Per User

Each person may maintain only one account. Creating multiple accounts is prohibited and may result in termination of all associated accounts.

4.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials;
• All activity that occurs under your account;
• Notifying us immediately at testonai.tech@gmail.com if you suspect unauthorised access.

We are not liable for any loss or damage arising from your failure to keep your credentials secure.

4.4 Account Accuracy

You agree to keep your account information up to date. We may suspend or terminate accounts with inaccurate or outdated information.

5. Description of the Service

TestOn AI is an AI-powered educational platform designed to help users create, manage, and study learning materials. The Service includes, but is not limited to:

5.1 Core Features

• Project Management: Create and organise study projects with multiple-choice questions (up to 5 options per question);
• Multiple Learning Modes: Tests, flashcards, matching games, memory games, voice answer, drawing game, typing quiz, game show mode, and more;
• Progress Tracking: View test results, identify difficult questions, and monitor study progress;
• Cross-Device Sync: Access your projects on any device;
• Export & Import: Export and import question sets.

5.2 AI Features

• AI Content Generation: Automatically generate questions, answers, and study materials using AI models (requires AI Credits);
• PROFESOR / TUTOR / AGENT Modes: Different AI generation approaches adapted to your study needs;
• Converter AI & Nobella AI: Additional tools for converting and generating educational content.

5.3 Social Features

• Multiplayer Rooms: Join or host real-time multiplayer quiz sessions;
• Project Sharing: Share your projects with others via a unique access token.

6. Subscription Plans & Pricing

TestOn AI offers the following subscription tiers, billed monthly in USD:

All prices are exclusive of applicable taxes. Prices may vary by region and are subject to change with advance notice.

6.1 Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. By subscribing, you authorise us to charge your payment method on a recurring basis.

6.2 Free Plan Limitations

The Free plan does not include access to AI features. It is limited to 5 projects and basic learning modes.

7. AI Credits System

AI Credits are the currency used to access AI-powered features within the Service.

7.1 Credit Allocation

Each subscription plan includes a monthly AI Credit allocation (see Section 6). Credits reset at the beginning of each billing cycle and do not carry over to the next period.

7.2 Credit Packs (One-Time Purchases)

You may purchase additional AI Credits through one-time Credit Pack purchases:

7.3 Credit Usage

1 AI Credit corresponds approximately to $0.001 of AI model processing cost. The exact cost per generation depends on the selected AI mode, complexity level (Low / Medium / High / Max), and the length of the generated output.

7.4 Expiry of Credit Packs

Credit Packs do not expire as long as your account remains active. However, Credits associated with a subscription plan reset monthly.

7.5 No Guarantee of Output

AI Credits are consumed when an AI generation is initiated regardless of whether the output meets your expectations. We do not guarantee specific output quality or accuracy.

8. Payment & Billing

8.1 Payment Processor

All payments are processed by Stripe, Inc., a third-party payment processor. By making a payment, you also agree to Stripe's Terms of Service and Privacy Policy. We do not store full credit card details on our servers.

8.2 Payment Methods

We accept major credit and debit cards and other payment methods supported by Stripe in your region.

8.3 Promotion Codes

We may issue promotional discount codes from time to time. Codes are single-use, non-transferable, and subject to expiry dates and specific terms.

8.4 Failed Payments

If a payment fails, your subscription may be downgraded or suspended. We will attempt to retry the payment. You are responsible for ensuring your payment method remains valid.

8.5 Taxes

Prices displayed do not include VAT, GST, or other applicable taxes unless stated otherwise. You are responsible for any taxes applicable to your purchases under local law.

9. Cancellations & Refunds

9.1 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Upon cancellation, your subscription remains active until the end of the current billing period, after which it downgrades to the Free plan.

9.2 Refund Policy

All subscription payments and Credit Pack purchases are generally non-refundable once the billing period has begun or the credits have been allocated to your account, except as required by applicable law.

9.3 EU Consumer Withdrawal Right

If you are a consumer in the European Union or European Economic Area, you have the right to withdraw from a purchase within 14 days of the transaction date, provided the digital service has not yet been fully performed and you have not expressly waived this right.

By subscribing to a paid plan or purchasing Credit Packs, you expressly acknowledge and consent to immediate performance of the service, and you understand that you forfeit your right of withdrawal once the service has been delivered (i.e., once your subscription is activated or credits are added to your account).

9.4 Exceptional Refunds

We may, at our sole discretion, issue refunds in exceptional circumstances (e.g., significant service outages or billing errors). Please contact us to discuss any billing concerns.

10. User Content & Intellectual Property

10.1 Ownership of User Content

You retain full ownership of all User Content you create through the Service. We do not claim ownership over your projects, questions, flashcards, or other materials.

10.2 Licence to TestOn AI

By submitting User Content to the Service, you grant TestOn AI a non-exclusive, worldwide, royalty-free licence to host, store, process, display, and reproduce your content solely to operate and improve the Service. This licence ends when you delete the content or your account.

10.3 TestOn AI Intellectual Property

The Service, including its design, logo, software, algorithms, AI models configuration, and all non-user-generated content, is the exclusive property of TestOn AI and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

10.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us an unlimited, irrevocable, royalty-free licence to use that feedback for any purpose.

11. AI-Generated Content

11.1 Nature of AI Output

The Service uses large language models (including but not limited to models provided by Anthropic, OpenAI, Google, and others, accessed via OpenRouter) to generate educational content. AI-generated content:

• May contain errors, inaccuracies, or outdated information;
• Should not be relied upon as the sole source of truth for academic, medical, legal, or professional purposes;
• May occasionally produce unexpected or inappropriate outputs.

11.2 Your Responsibility

You are responsible for reviewing and verifying AI-generated content before using it in any educational or professional context.

11.3 Ownership of AI Output

AI-generated content produced in response to your prompts belongs to you, subject to the terms of the underlying AI model providers. You are responsible for ensuring your use of AI-generated content complies with applicable laws and regulations.

11.4 No Endorsement

TestOn AI does not endorse or guarantee the accuracy, completeness, or reliability of any AI-generated content.

12. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law or regulation;
• Upload, distribute, or generate content that is defamatory, obscene, hateful, threatening, or infringes third-party rights;
• Infringe copyright, trademark, or other intellectual property rights;
• Upload malware, viruses, or any malicious code;
• Attempt to gain unauthorised access to any part of the Service or its infrastructure;
• Scrape, crawl, or systematically extract data from the Service without our written consent;
• Use the AI features to generate spam, phishing content, or deceptive materials;
• Harass, bully, or intimidate other users;
• Circumvent access controls, subscription limits, or credit systems;
• Share your account credentials with others.

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

13. Multiplayer & Sharing Features

13.1 Multiplayer Rooms

The Service includes real-time multiplayer quiz rooms. By using multiplayer features, you agree to:

• Behave respectfully towards other participants;
• Not use multiplayer sessions to share prohibited content;
• Accept that room sessions may be recorded for security and debugging purposes.

13.2 Project Sharing

When you share a project via a sharing token, you grant other users the ability to view and use your project content. You remain responsible for the content you share. You may revoke sharing access at any time through your account settings.

13.3 Shared Content Responsibility

TestOn AI is not responsible for content shared between users. If you encounter inappropriate shared content, please report it to testonai.tech@gmail.com.

14. Third-Party Services

The Service integrates with the following third-party providers:

• Supabase – Database and authentication infrastructure;
• Stripe – Payment processing;
• Google – OAuth login (optional);
• OpenRouter – AI model routing and access;
• Vercel / Cloudflare – Hosting and content delivery.

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the actions or content of third-party providers.

15. Service Availability & Modifications

15.1 Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted, error-free access. The Service may be temporarily unavailable due to maintenance, updates, or infrastructure issues.

15.2 Modifications

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time. We will provide reasonable advance notice of material changes where practicable.

15.3 Feature Changes

Features included in your subscription plan may change over time. We will communicate significant changes that affect your plan's core functionality with at least 14 days' notice.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements;
• AI-generated content will be accurate, complete, or suitable for your purposes;
• The Service will be uninterrupted, timely, or error-free;
• Any errors in the Service will be corrected.

This disclaimer applies to the maximum extent permitted by applicable law. Some jurisdictions do not allow the exclusion of implied warranties, so the above may not apply to you.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TESTON AI AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability to you for all claims arising from these Terms or your use of the Service shall not exceed the greater of:

• The amount you paid to us in the 3 months preceding the claim; or
• USD $50.

This limitation does not apply to damages caused by our gross negligence or wilful misconduct, or where exclusion is prohibited by law (including EU consumer protection law).

18. Indemnification

You agree to indemnify, defend, and hold harmless TestOn AI and its affiliates, officers, employees, and agents from any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these Terms;
• Your User Content;
• Your violation of any applicable law or regulation;
• Your infringement of any third-party rights.

19. Termination

19.1 Termination by You

You may delete your account at any time through your account settings. Upon deletion, your data will be permanently erased within 30 days, except where we are required by law to retain it. Deleted accounts cannot be recovered.

19.2 Termination by Us

We may suspend or permanently terminate your access to the Service, with or without prior notice, if you:

• Breach these Terms or our Acceptable Use Policy;
• Engage in fraudulent activity;
• Use the Service in a way that could harm other users or the Service itself.

19.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 10, 11, 16, 17, 18, and 20) shall continue to apply.

20. Governing Law & Dispute Resolution

20.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [COUNTRY/JURISDICTION – e.g. Poland / Republic of Poland], without regard to conflict-of-law principles.

20.2 Dispute Resolution

We encourage you to contact us first at testonai.tech@gmail.com to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts of [CITY, COUNTRY].

20.3 EU Online Dispute Resolution

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

21. Consumer Rights (EU)

Nothing in these Terms affects your statutory rights as a consumer under EU law, including:

• The right to withdraw from digital service contracts within 14 days (subject to the waiver described in Section 9.3);
• Rights under the EU Digital Content Directive (2019/770);
• Rights under Regulation (EU) 2016/679 (GDPR) as described in our Privacy Policy;
• The right to lodge a complaint with your national data protection authority.

22. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by:

• Sending an email to the address registered on your account; and/or
• Displaying a prominent notice within the Service.

Changes take effect 14 days after notification for existing users (immediately for new users). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
